PARKING PASS TERMS OF USE

 

PLEASE READ CAREFULLY AND COMPLETELY. THESE TERMS (AS DEFINED BELOW) CONTAIN ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT IMPACT YOUR LEGAL RIGHTS.

ACCEPTANCE AND USE OF ANY AMERICAN AIRLINES CENTER (“CENTER”) PARKING PASS IS SUBJECT TO THESE TERMS OF USE (THESE “TERMS”) SET FORTH HEREIN AND THOSE ADDITIONAL CENTER POLICIES AVAILABLE AT:

(COLLECTIVELY, THE “WEBSITE”), WHICH ARE INCORPORATED HEREIN BY REFERENCE. BY ACCEPTING AND/OR USING ANY PARKING PASS, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ, UNDERSTOOD, AND ARE BOUND BY THESE TERMS AND SUCH ADDITIONAL CENTER POLICIES ON THE WEBSITE, WHICH CONTAIN ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT IMPACT YOUR LEGAL RIGHTS.

Each parking pass is a revocable license to access and use one (1) parking spot for the sole purpose of parking one (1) vehicle within the area designated by such parking pass in connection with a specified game or event hosted at the Center (each, an “Event”). The purchaser and/or bearer of the parking pass to an Event, and any individual seeking entry to a parking lot or garage through the use of such parking pass, including minors and all other attendees accompanying any parking pass bearer (on whose behalf the purchaser and/or bearer represents they are authorized to act for purposes of agreeing to these Terms) (each of the foregoing hereinafter a “Holder”), agrees that (i) such license is subject to these Terms, and (ii) by purchase, acceptance, and/or use of such license, each Holder is deemed to have read and understood these Terms, and agreed to be bound by them. Failure to comply with these Terms shall result in forfeiture of the license and all rights arising under it without refund and entitle Center Operating Company, L.P. (“Management”) to pursue all legal remedies available. 

ALL PARKING PASS SALES ARE FINAL. NO REFUNDS OR EXCHANGES EXCEPT AS PROVIDED HEREIN. THE SOLE AND EXCLUSIVE REMEDY OF A HOLDER IF ADMISSION IS REFUSED OR REVOKED WITHOUT CAUSE, CAPACITY LIMITS RESULT IN PARKING PASS CANCELLATION, IF THE APPLICABLE EVENT IS CANCELLED AND NOT RESCHEDULED FOR ANY REASON, OR FOR ANY BREACH OF THESE TERMS BY MANAGEMENT IS A REFUND OF THE AMOUNT PAID TO CENTER FOR SUCH PARKING PASS (“FACE VALUE”). IN NO EVENT SHALL HOLDER BE ENTITLED TO ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY AMOUNT PAID IN EXCESS OF FACE VALUE FOR THE PARKING PASS.

ANY DISPUTE, CLAIM, OR CAUSE OF ACTION IN ANY WAY RELATED TO THE PARKING PASS, THE PARKING LOT OR GARAGE, OR THE EVENT SHALL BE RESOLVED BY MANDATORY, CONFIDENTIAL, FINAL, AND BINDING ARBITRATION BEFORE ONE (1) ARBITRATOR OF THE AMERICAN ARBITRATION ASSOCIATION (AAA) LOCATED IN DALLAS, TEXAS, PURSUANT TO ITS CONSUMER ARBITRATION RULES (AVAILABLE AT WWW.ADR.ORG) AND APPLYING TEXAS SUBSTANTIVE LAW, REGARDLESS OF WHERE HOLDER OR HOLDER’S RELATED PERSONS RESIDE OR FROM WHERE THE PARKING PASS WITH WHICH HOLDER OR HOLDER’S RELATED PERSON SEEKS ADMISSION WAS PURCHASED OR RECEIVED. HOLDER AND MANAGEMENT AGREE THAT ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS. HOLDER UNDERSTANDS, ACKNOWLEDGES, AND AGREES THAT THEY ARE WAIVING THEIR RIGHT TO A COURT OR JURY TRIAL AND ANY RIGHT TO LITIGATE OR ARBITRATE ANY CLAIM AS A CLASS ACTION, REPRESENTATIVE ACTION, OR CLASS ARBITRATION. IF HOLDER DOES NOT CONSENT TO THIS CLAUSE, HOLDER MUST LEAVE THE PARKING LOT OR GARAGE AND SHALL NOT ENTER THE CENTER. THIS CLAUSE IS GOVERNED BY THE FEDERAL ARBITRATION ACT.

ADMISSION TO A PARKING LOT OR GARAGE MAY BE REFUSED OR REVOKED AND HOLDER MAY BE EJECTED IN MANAGEMENT’S SOLE DISCRETION. MANAGEMENT, DALLAS BASKETBALL LIMITED, AND DSE HOCKEY CLUB, L.P. EACH RESERVE THE RIGHT TO DENY OR REVOKE THE ENTRY OF, AND TO BAN FROM FUTURE NATIONAL BASKETBALL ASSOCIATION (NBA) AND/OR NATIONAL HOCKEY LEAGUE (NHL) GAMES AND EVENTS, ANY PERSON TO THE CENTER WHO IT DETERMINES, IN ITS SOLE DISCRETION, POSES A RISK TO THE HEALTH, SAFETY, OR ENJOYMENT OF OTHER ATTENDEES OR WHOSE CONDUCT VIOLATES THESE TERMS, ANY MANAGEMENT POLICIES, OR IS OTHERWISE DISORDERLY (OR COMPLICIT THEREIN) WITHOUT REFUND.

Management is not responsible for and assumes no liability arising from lost, stolen, destroyed, duplicated or counterfeit parking passes and may refuse to honor the same. Parking passes may not be used for, or in connection with, any form of commercial purposes including, without limitation, advertising, promotions, contests, sweepstakes, giveaways, gambling, or gaming, without the express written consent of the Management, Dallas Basketball Limited, DSE Hockey Club, L.P., the NBA, and/or the NHL. Use of parking passes in violation of law is strictly prohibited and will result in seizure, revocation, and/or forfeiture of the license without refund.

Any collection, use, and/or disclosure of Holder data in connection with Holder’s use of any parking pass, attendance at an Event, or use of the websites, mobile applications, and other online or offline services of Management, Dallas Basketball Limited, DSE Hockey Club, L.P., the NBA, and/or the NHL, including, without limitation, use of the Center’s Wi-Fi network, are subject to Management’s Privacy Policy located at https://www.americanairlinescenter.com/privacy-policy.

Parking. The times that parking areas are open differ by lot and/or garage. Generally, the Lexus Garage (accessible from N. Houston Street) opens at Noon (12:00PM CT) on Event days and all other parking lots and garages open two (2) hours prior to the start of each Event, all of which remain open for two (2) hours after the end of each Event. You may be redirected to a different lot or garage if your designated parking area is full when you arrive, which determination shall be made in Management’s sole discretion. Failure to prominently display a parking pass or comply with these Terms and/or any Center policies may result in the immediate revocation of parking privileges. Vehicles are prohibited from entering or remaining within parking areas outside of designated operating times. SUCH VEHICLES ARE SUBJECT TO TOW AND REMOVAL AT THE OWNER’S SOLE EXPENSE. None of Management, Dallas Basketball Limited, DSE Hockey Club, L.P., or any of their respective affiliates, employees, agents, and representatives are responsible for and assume no liability whatsoever for any loss, theft, damage, and/or injury (whether to vehicle, its contents or property, or otherwise) related to any access to and/or use of the area designated by a parking pass, whether occurring before, during, or after the applicable Event, however caused. DO NOT LEAVE VALUABLES IN ANY VEHICLE!

CENTER POLICIES, INCLUDING, BUT NOT LIMITED TO, OPENING AND CLOSING TIMES, ARE SUBJECT TO CHANGE AT MANAGEMENT’S DISCRETION. BEFORE ATTENDING ANY EVENT, PLEASE CHECK THE WEBSITE FOR THE HOURS THAT YOUR DESIGNATED PARKING AREA IS OPEN. THESE TERMS ARE SUBORDINATE TO ANY POLICIES SET FORTH ON THE WEBSITE.

Accessible Parking. Accessible parking spots are available for those with a valid handicapped/disabled parking placard and matching photo ID. Accessible parking spots are located in various designated parking areas and are on a first-come, first-served basis. Accessible parking locations and information are available on the Website. Mobility assistance is available within the Center and may be requested at the North Entrance of the Center (accessible from All Star Way).

No Tailgating.  For the safety of all Center patrons and guests, grilling, open flames, food preparation, and/or consumption of alcoholic beverages are not permitted in any parking area at any time.

No Drones. The use of drones, unmanned aerial vehicles, and/or other remotely controlled aircraft or ground vehicles in any parking area is strictly prohibited.

Report Security Concerns, Facility Maintenance, and/or Unruly Behavior.  Should you encounter any problems, public safety, or security concerns, please: (i) notify the nearest parking attendant, and/or (ii) send a message to Management via www.tellAAC.com. For emergencies, find your nearest law enforcement officer or call 911 immediately. See Something, Say Something!

Code of Conduct. Every guest who visits the Center deserves the best possible experience. All guests, including, but not limited to, any Holders, must conduct themselves appropriately at all times and comply with the Center’s Code of Conduct and other policies (available at https://www.americanairlinescenter.com/plan-your-visit/arena-faq and  https://www.americanairlinescenter.com/plan-your-visit/fan-safety-guidelines). 

HOLDER KNOWINGLY AND VOLUNTARILY ASSUMES ALL RISKS, HAZARDS AND DANGERS incidental to acceptance and/or use of any parking pass, access and/or use of any related parking area designated by such parking pass (including, but not limited to, any lot or garage) and Event, including, but not limited to, the risk of personal injury (including death), exposure to communicable diseases, viruses, or bacteria or illnesses (including, for example, COVID-19) or the causes thereof, and/or lost, stolen, or damaged property, whether occurring before, during, or after any Event, however caused, and hereby waives all claims and potential claims relating to such risks, hazards and dangers. Holder should not assume that the area designated by any parking pass is secure or actively monitored. Attendants are present solely to validate parking passes and/or collect parking fee payments. Attendants are unable to verify ownership of vehicles departing any parking area.

RELEASE, WAIVER & COVENANT NOT TO SUE. On behalf of Holder and Holder’s Related Persons (as defined below), Holder knowingly and voluntarily releases and covenants not to sue each of the Released Parties with respect to any and all claims that Holder or any of Holder’s Related Persons may now have or that hereafter accrue, whether known or unknown, against any of the Released Parties that relate to any of the risks, hazards, and/or dangers described above or resulting from anything which has happened up to now, including, without limitation, any and all claims that arise out of or relate in any way to Holder’s or Holder’s Related Persons’ entry into, or presence within or around the Center and/or Event (including, without limitation, in any parking areas designated by a parking pass or entry gates), in each case whether caused by any action, inaction, or negligence of any Released Party or otherwise. HOLDER AND HOLDER’S RELATED PERSONS UNDERSTAND THAT THEY ARE RELEASING AND WAIVING CERTAIN POTENTIAL RIGHTS HELD BY HOLDER AND HOLDER’S RELATED PERSONS. TO THE EXTENT APPLICABLE HOLDER KNOWINGLY AND VOLUNTARILY WAIVES THE PROVISIONS OF SECTION 1542 OF THE CALIFORNIA CIVIL CODE AS AGAINST EACH RELEASED PARTY WITH REGARD TO CLAIMS RELEASED HEREBY AND ACKNOWLEDGES AND AGREES THAT THIS WAIVER IS AN ESSENTIAL AND MATERIAL PART OF THESE TERMS. HOLDER FURTHER ACKNOWLEDGES THE SIGNIFICANCE AND CONSEQUENCE OF THE RELEASE AND THE SPECIFIC WAIVER OF SECTION 1542 OF THE CALIFORNIA CIVIL CODE.

As used herein:

  • Related Persons” means Holder’s heirs, assigns, executors, administrators, next of kin, anyone entering the parking area or attending the Event with Holder (which persons Holder represents have authorized Holder to act on their behalf for purposes of agreeing to these Terms, including the release herein), and other persons acting or purporting to act on Holder’s or their behalf.
  • Released Parties” means: (i) Management, Center GP, LLC, Arena Operating Company, Inc., the City of Dallas, Texas, Dallas Basketball Limited d/b/a the Dallas Mavericks, DBL Arena Partners, Inc., Radical Arena, Ltd, Radical Arena II, Ltd, Dallas Sports Group, LLC, Dallas Sports Group Management, LLC, DSE Hockey Club, L.P. d/b/a the Dallas Stars, DSE Hockey Centers, L.P., DSE Hockey Centers GP, Inc., DSE Hockey Club GP, Inc., Dallas Sports and Entertainment, L.P., DSE GP, Inc., the NBA, the NHL, and each of their respective direct and indirect affiliates, administrators, designees, licensees, agents, owners, officers, directors, employees, contractors (and their employees) and other personnel; (ii) the direct and indirect owners, lessees, and sublessees of the Center and related parking areas or grounds (including, without limitation, parking lots and garages); (iii) all third parties performing services at the Center; and (iv) any parents, subsidiaries, affiliated and related companies, and officers, directors, owners, members, managers, partners, employers, employees, agents, contractors, subcontractors, insurers, representatives, successors and/or assigns of each of the foregoing entities and persons, whether past, present or future and whether in their institutional or personal capacities.

Governing Law. These Terms and any dispute arising from, relating to, or in connection with these Terms shall be governed by, construed, and enforced in accordance with the laws of the State of Texas, without regard and/or reference to its conflict of laws principles.

Severability Clause. If any provision of these Terms is determined to be invalid, illegal, or unenforceable, it shall be deemed severed and not affect the enforceability of any other provisions, which shall be enforced as if these Terms did not contain the invalid, illegal, or unenforceable provision.
